PRIVACY POLICY

 

1. Introduction

This Privacy Policy is issued by Conair Australia Pty Limited (ABN 64 068 492 044) of Suite 101, 18 Rodborough Rd, Frenchs Forest NSW Australia 2086 and Conair New Zealand Limited (NZBN 9429037166267) of 127 Main Highway, Ellerslie, Auckland 1051, New Zealand (“Conair”, “we”, “our” or “us” as the context may require). We view privacy as a serious matter and we strictly adhere to the Australian Privacy Principles (“APPs”) as set out in the Privacy Act 1988 (Cth) (“AU Privacy Act”) and the New Zealand Information Privacy Principles (“IPPs”) as set out in the Privacy Act 2020 (NZ) (“NZ Privacy Act”). It is important for you to understand what information we collect about you and what we do with that information.

We will collect, disclose, handle and use personal information as described in this Privacy Policy, as authorised by you and/or as required or authorised by law. This Privacy Policy also sets out some of your privacy rights in relation to personal information and advises how you can contact us with privacy queries. By providing your personal information to us or accessing, browsing or using any website owned and/or operated by Conair (each a “Site”) and our applications, you agree to this Privacy Policy.

2. Collection of Personal Information

We collect personal information in a variety of ways, being when you knowingly provide it to us, such as when you contact us with questions or complaints, purchase our products, use our Sites or our applications or participate in our offers/promotions, including online (via Sites or applications), via phone, social media, fax, email, in person, mail or otherwise. We may also gain further insights about you through product reviews, reporting, analysis and via the use of cookies, tags and pixels (as detailed below). We aim only to collect personal information that is necessary to carry on our business and to supply you with the goods and/or services that you have contracted or requested us to provide. However, we may also collect information about you to do internal research and to conduct market research for our own purposes.

This information could include, but is not limited to:

  • Your name, email address, telephone or mobile number, e-mail, social media handles, mailing address, place and date of any product/s you purchase;
  • Payment details such as your credit card number and billing information; and
  • Other information that you provide to us such as gender, date of birth, age group, product preferences and interests.

For example, if you decide to complete a survey, enter a competition or the registration of a product warranty, you may be asked to provide certain information such as your contact information (name, e-mail address, telephone number and mailing address), gender, birth date, age group and product purchased and/or preferences and interests, and the brands and products you use. Similarly, if you use one of our applications, you may be required to create an account by providing your name, email address and other details as requested.

Unless stated otherwise to you, we do not collect sensitive personal information such as political or religious beliefs, health status, ethnic background or sexual preference.

While we endeavour to only collect personal information from you directly, we may also collect information from the following sources that you may be unaware of including:

  • Third parties (via agencies on our behalf, business partners or our Internet service provider);
  • Public directories and listings;
  • Personal interactions with our employees; and
  • Electronic information from e-mail or the Internet.

Before collecting information of a sensitive nature or information relating to your health, we will seek consent from the individuals concerned.

Any financial information that is collected in order to procure payment for goods or services, such as credit card or banking details, will be treated in a different manner from the rest of your personal information, as detailed below.

3. Use and Disclosure of Information

If you submit your personal information to us, you are giving your consent to the collection, use and disclosure of your personal information as set forth in this Privacy Policy. If you would prefer that we do not collect any personal information from you, please do not provide us with any such information. If you choose not to provide that information, then we will not be able to send you information or products that may be of interest to you and/or you may not be able to access or use some of our services, products, Sites or applications.

The personal information you provide will generally only be used for the purposes it was collected and for other related purposes as permitted by law, including the following:

  • To answer your queries or provide the goods and/or services and/or products requested/ordered;
  • The purpose of creating and delivering to you our catalogues, surveys, other marketing communications containing product information, product usage tips, and promotions. If you prefer not to receive e-mail communications or our catalogue, please see section 10 below.
  • To facilitate your participation in our offers or promotions;
  • To enable us to improve and develop our products and services;
  • To understand your needs, to customise services to meet your needs and preferences, and to provide you with a better service;
  • To undertake data processing, data analysis, market research or trend analysis to enable us to better understand your requirements, behaviour and preferences and to tell you about products that may be of interest to you;
  • To conduct our business;
  • To provide you access to certain aspects of our Sites or applications;
  • To deal with any enquiries or complaints and for support purposes; and
  • To comply with our legal obligations or as required or authorised by law.

We may contact you in relation to the above via electronic messaging such as SMS and email, by mail, phone or in any other lawful manner.

When you visit our Site(s), use our applications or view one of our e-mails, we may use pixel tags (also called "clear" gifs) and/or similar technology to note some of the pages you visit on our Sites or applications and personalise your experience. We may also use pixel tags to determine what types of e-mail your browser supports. We may use the information collected through pixel tags in combination with your personal information as set forth in this Privacy Policy.

We may also use the information you provide in aggregate form for internal business purposes, such as generating statistics and developing marketing plans. We will not sell or rent your personal information to third parties without your consent, except as disclosed in this Privacy Policy and/or at the time of collection.

We may disclose your personal information:

  • Where we have sought your consent or as is otherwise allowed or required by law;
  • To our related companies, contractors, suppliers or service providers for the purposes of providing products and services on our behalf and performing our administration and other operations, including accounting and finance checks, IT, marketing, record keeping and statistical purposes, market research, safety purposes, fulfilment services and/or Site traffic analysis;
  • To any entity to which we propose to assign any part of our business, including data analysis firms, customer support specialists, webhosting companies, advertising agencies and fulfilment companies (e.g., companies that coordinate mailings); or
  • To other organisations with whom we have contractual agreements.

We confirm that any such third parties that may be provided with access to personal information needed to perform their functions, may not use such information for any other purpose. Such third parties may also use the information collected in aggregate form for their internal business purposes, such as generating statistics for marketing materials.

We will only use sensitive information, such as payment, credit card and banking information, that we hold about you for the primary purpose for which it was collected or for a purpose directly related to the primary purpose, and where you would reasonably expect us to use or disclose it for that purpose.

We do not use or disclose personal information on public Artificial Intelligence (“AI”) platforms. We do not permit personal information to be used or disclosed on public Generative AI platforms.  We also do not use or disclose personal information for automated decision-making purposes.

4. Disclosure of Personal Information to Third Parties Outside of Australia and New Zealand

Personal information which we collect and hold is stored within our locally housed data servers in Australia. However, we utilise some cloud-based service providers for specific functions, such as email and accounts, who may store certain information on our behalf on servers based in the United States of America, the United Kingdom and Hong Kong. These service providers are engaged pursuant to terms of service requiring stringent privacy compliance in respect of this data.   

Some of the companies we may disclose your personal information to are located overseas, including the United States of America, the Unted Kingdom and Hong Kong.  In all instances of overseas disclosure, we shall ensure that the transfer of your personal information is carried out in accordance with all applicable privacy and data protection laws.

Except as outlined above, we do not generally disclose personal information to entities located outside of Australia and/or New Zealand, unless:

  • It is necessary (including to provide the personal information to a third party) to provide our goods and/or services to you;
  • You have provided your consent; 
  • We believed on reasonable grounds that the organisation involved would only deal with your personal information in a similar manner to the requirements under the APPs or IPPs (as applicable); or 
  • Where otherwise allowed by the AU Privacy Act or NZ Privacy Act (as applicable). 

5. Cookies and Log Files

We may place a "cookie" on your computer's hard drive so we can recognise you as a return user and personalise your experience. A cookie is a piece of data that enables us to track and target your preferences. The cookie will be stored on your computer's hard drive until you remove it. For the avoidance of doubt, the cookie does not identify you or give us any information about your computer, so it is not personally identifiable information under either Australian or New Zealand law. You can have your browser notify you of, or automatically reject, cookies. If you reject our cookie, you may still use our Sites, but you may be limited in the use of some of the features. Some of our business partners may also use cookies on our Sites and applications. However, we have no access to, or control over, these cookies used by other business partners and do not accept any responsibility for such use.

In addition, we may use IP addresses to analyse trends, administer our Sites, track traffic patterns, and gather demographic information for aggregate use. Except as otherwise disclosed in this Privacy Policy, we will not use IP addresses in combination with your personal information without your prior consent.

With most Internet browsers, you can erase cookies from your computer hard drive, block all cookies, or receive a warning before a cookie is stored. If you want to do this, refer to your browser instructions or help screen to learn more.

6. Links

Our Sites and applications may contain links to or from other websites and applications. Please be aware that we do not control and are not responsible for the privacy practices of other websites and applications. This Privacy Policy applies only to the information we collect through our Sites and in the course of our business, and does not apply to any third-party websites or applications. When you leave our Sites or applications, any information you provide is governed by the privacy policy of the relevant website or application, which we encourage you to review carefully.

7. Storage and Security

As noted above, we may store personal information on internal computer databases, local hard drives and/or in hard copy at our offices. We may also engage third party service providers to assist in storing and processing certain types of personal information for us.

Any information that we no longer use for the purposes contained in this Privacy Policy is destroyed.  The exception to this may be information required for possible data analysis at a future date, or information we are legally required or advised to hold for specific time periods.  Wherever possible, the information will be retained in a form that does not allow you to be identified.

The security of your information is extremely important to us.  When we have collected information about you it cannot be seen or modified by anyone other than those authorised to access the information for the purposes stated above. We will endeavour to make reasonable efforts to ensure information is stored securely in electronic form and to keep this information accurate, up to date, complete and relevant. We ensure that only those necessary have access to your personal information.  Electronic and managerial procedures have been put in place to reasonably secure any information collected from misuse, interference or loss, and in order to prevent unauthorised access, modification to or disclosure of that information. We utilise systems, services and third party platforms to manage and store your personal information that are located outside of Australia and New Zealand. However, we will never lose effective control of your personal information.

8. Business Transfers

As we continue to develop our business, we might sell certain assets. In such transactions, user information, including personal information, generally is one of the transferred business assets, and by submitting your personal information to us you agree that your data may be transferred to such parties in these circumstances.

9. Notification of Changes

We may revise this Privacy Policy from time to time. If we decide to change our Privacy Policy, we will post the revised policy here. We suggest that you periodically consult this Privacy Policy.  All changes are effective from the date of posting the revised Privacy Policy.  By continuing to use the Site(s) and our applications after the Privacy Policy has been varied or by otherwise providing your information to us, you agree to be bound by the variation.

10. Choice/Opt-Out/Access/Correction/Complaints

When you register a product warranty, complete a feedback form or one of our surveys, enter a competition or post a product review on our Site, you may opt-out of receiving future marketing communications from us. You may change your e-mail preferences at any time by clicking the "unsubscribe" link at the bottom of each e-mail you receive from us or by e-mailing us at aus_cuisinart@conair.com (for Cuisinart) or aus_info@conair.com (for all other Conair brands). 

You may gain access to your personal information held by us or correct that information at any time on reasonable notice. If you make a request for more detailed personal information, for example, access to information held in archives, you may incur a reasonable fee to cover the cost of retrieval and the supply of this information to you (we will notify you if any fee is applicable and any such fee will only be applied in accordance with the applicable laws).

We will take reasonable steps to amend or correct your personal information to keep it accurate and up to date. If you believe that any information we hold about you is incorrect or incomplete, please write or email us as soon as possible via the details below. We will promptly correct any information found to be incorrect.

All requests for access to personal information will be handled as quickly as possible and we shall endeavour to process any request for access within thirty (30) days of having received the request.

We are not always required to provide access to personal information upon request. Access may be refused in a number of circumstances, subject to the applicable law, such as:

  • Where the information may relate to existing or anticipated legal proceedings;
  • Where required or authorised by law;
  • Where the request is regarded as frivolous or vexatious.

If access is denied, we will explain why.

If you have a concern or complaint in relation to our handling of your personal information or you believe that we have breached the AU Privacy Act and/or the APPs, the NZ Privacy Act and/or the IPPs or any other applicable privacy laws or codes, you can contact us via the details below. We will investigate your concerns and will respond to you in writing as soon as possible (usually within thirty (30) days).
